What is a Burn Ban?
ALL forms of open flames within the Fire District will be restricted for the remainder of Fire Season.
Why do we need a Burn Ban Ordinance?
There is an increased threat of wildfire when open burning and recreational fires are allowed during times of high fire danger. Improperly extinguished recreational fires and open burning have the potential to start uncontrolled fire and threaten nearby wildland and structures. By banning open burning and recreational fires during high fire season, the threat of wildfire can be reduced.
What is banned?
Campfires (on public and private land), Bonfires, Portable Outdoor Fireplaces, Ceremonial Fires and Recreational Fires, as defined in the 2022 California Fire Code.
What is allowed?
UL or ASMI listed manufactured GAS (LPG or NG) outdoor flame devices.
When does the Burn Ban apply?
By Ordinance, MOFD’s burn ban comes into effect 24 hours after CAL FIRE SANTA CLARA UNIT (SCU) declares a ban on open burning.
Outside of traditional fire season, the burn ban can also be instituted at any time the Fire Chief finds that conditions or other local circumstances make such fires hazardous, including when factors, such as high winds, low fuel moistures, fire weather, the issuance of red flag warnings, or severe threat of wildland fire, present the risk of destruction by wildfire to life, wildlife, property or natural resources. As a general rule, the Burn Ban will apply in the late summer and fall months when the combination of high winds, dry air, and low fuel moisture content increase the risk of wildfire.
Can a wood pellet fuel based BBQ/smoker (i.e.,Traeger) be used?
Yes, pellet burning devices contain heat and ash and fully consume the pellets with no super-heated particles remaining that could start a fire after disposal.
Is there an exception for special events or commercial cooking?
Yes, exceptions to the Burn Ban may be made with a permit. In these cases, an inspection will be conducted and a permit outlining specific operating guidelines will be issued. For permits, please contact the Fire Marshal’s office.
